Participant safety agreement
Please read this document carefully. It describes safety responsibilities, acknowledgment of risk, and retained legal rights.
1. Who is accepting
I am at least 18 years old and accept this agreement for myself. Booking the equipment does not sign away another guest's rights. Each adult participant must receive the safety instructions and complete their own agreement before use. Any participation by minors requires a separate policy and consent process approved by Peak Heat; this adult agreement does not authorize a minor's participation or release a minor's claims.
2. Understanding the equipment and risks
The rental may include a wood-fired sauna and, where included in the booking, a cold plunge. Heat, cold water, fire, hot surfaces, wet surfaces, weather, and the delivery site can cause injury. Possible harms include burns, slips, falls, dehydration, overheating, fainting, cold shock, breathing difficulty, drowning, smoke or carbon-monoxide exposure, and serious injury or death. Moving between hot and cold environments can add risk. These examples are not a guarantee that every hazard has been identified.
3. Personal health and voluntary participation
Participation is voluntary. Peak Heat does not provide medical advice, screen participants for medical fitness, or promise health benefits. I will seek advice from a qualified health professional before participating if I have a health condition, am pregnant, take medication affecting heat or cold tolerance, or am unsure whether participation is appropriate. I may stop at any time.
4. Safe use
I will read and follow the equipment instructions and delivery briefing before use, including the stated occupancy, temperature, fuel, ventilation, and operating limits. I will not participate while impaired. I will not use the equipment alone. I will keep exits and ventilation clear, avoid contact with hot equipment, and use care on wet or icy surfaces. I will not move the trailer, alter the setup, tamper with safety equipment, or use unapproved fuel or accelerants. I will not dive into the plunge or hold anyone underwater. I will stop use immediately if I feel unwell or notice unsafe conditions, leave the equipment safely, and seek help. For an emergency, call 911 first. Equipment concerns should also be reported to Peak Heat.
5. Delivery site and supervision
The renter must obtain permission to use the delivery site, disclose access restrictions and known hazards, and maintain the agreed access and clearances. Peak Heat determines whether it can safely deliver and set up the equipment. The renter must not reposition it after setup. The renter will give all guests the safety instructions and prevent unauthorized use. Unless separately agreed in writing, Peak Heat does not provide an attendant or lifeguard throughout the rental. Peak Heat may suspend use or retrieve equipment when reasonably necessary for safety; any payment adjustment follows the booking terms and applicable law.
6. Acknowledgment of risk and retained legal rights
I understand the risks described above and voluntarily choose whether to participate. I accept responsibility for my own conduct and compliance with the safety instructions. This acknowledgment does not excuse unsafe equipment, waive claims for Peak Heat's negligence, or release claims that cannot lawfully be waived. Nothing in this agreement releases gross negligence, reckless conduct, intentional misconduct, or other liability protected by applicable law. It does not require me to indemnify Peak Heat for its own wrongdoing.
7. Equipment loss and damage
The renter is responsible for reasonable, documented loss or damage caused by their misuse, unauthorized movement, alteration, or failure to follow instructions, and any responsibility for guests must be stated in the rental terms. Ordinary wear, pre-existing damage, and damage caused by Peak Heat are excluded. Peak Heat will provide the renter with an explanation and supporting documentation for a proposed charge and an opportunity to raise a dispute. Accepting this agreement alone does not authorize an unspecified charge to a stored payment card.
8. Acceptance and records
I have had an opportunity to read this agreement, ask questions, and save a copy. Checking the unchecked agreement box and submitting the form constitutes my electronic acceptance of this version for the booking above. No handwritten or drawn signature is required. Peak Heat will retain the agreement version, participant identity, booking reference, and acceptance time under its privacy policy. Booking acceptance by the renter does not substitute for separate participant acceptance.Required unchecked checkbox: “I am at least 18 and agree to the Participant Safety and Rental Responsibility Agreement. By checking this box and submitting, I electronically accept this agreement for myself.”Acceptance record: participant name and email, booking reference, exact agreement version, and server-recorded date/time.
9. Applicable law
New York law governs to the extent applicable. Mandatory legal protections remain in effect. If a provision is invalid, the remaining provisions apply only to the extent permitted by law. This agreement does not add mandatory arbitration or a waiver of jury trial.
